I operate some of the time as a professional photographer – as some of my Facebook friends also do. From that aspect alone, I would like to try and clear up something.

When a person is in a public thoroughfare (street/forest/road,etc), it’s generally accepted by a court that they are at a location where one might be expected to be seen – and that there should be by everyone there, a reasonable expectation of one’s image bring captured while being part of a scene.

Therefore, anyone with a camera taking pictures, might capture the whole environment, people and all, before then reporting on it all.

However, on a private property – be it a nightclub or church, etc – there is more expectation of personal privacy. For example: a nightclub might have public in it, but it’s not an open public place.

While full privacy is expected to be more questionable and more reasonably applicable, permission to capture pictures of such locations (and all those extra in it beyond just family/friends) is usually expected to be obtained first from the property owner or manager.

Anyone taking pictures of another specific person on a private property, deliberately covertly, can easily find themselves in legal ‘hot water’ especially if it can be indicated that a form of potential (sudden iniciated or pre-planned) stalking has been carried out.

Question: Would anyone here like their daughter to be covertly photographed on a private property without her permission? Now apply those same feelings on this matter not just to females – but now males too!

I will be forthcoming here. I absolutely detest Leo Varadkar, his politics, his party, his law breaking as I see it, his many corrupt antics as I have judged them, etc… That said, there must be no discrimination about how we apply the laws of our land just because we don’t like someone. To start doing that, leads to a domino falling effect regarding our laws – where thereafter we can come up with any excuse to justify anything – and expect to get away with it all.

Hell… Leo’s own acts alone, along with SIPO saying they cannot hold him to account, just goes to prove this! We must try to be better than what comes before us.
